By accessing this website or using our services, you accept these terms and conditions. Unless otherwise stated, David Seginer Photography and/or its licensors own the intellectual property rights for all materials on this website. You may view and/or print pages from https://www.davidseginerphotography.com for your own personal use subject to restrictions set in these terms and conditions.

You are specifically restricted from all of the following:

Selling, sublicensing, and/or otherwise commercializing any website material.
Publicly performing and/or showing any website material without explicit written permission.
Using this website in any way that is, or may be, damaging to this website.

In these terms and conditions, "Your Content" shall mean any audio, video, text, images, or other material you choose to display on this website. By displaying Your Content, you grant David Seginer Photography a non-exclusive, worldwide irrevocable, sub-licensable license to use, reproduce, adapt, publish, translate, and distribute it in any and all media.

4. Limitation of Liability

In no event shall David Seginer Photography, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this website or our services. David Seginer Photography shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website or our services.

5. Indemnification

You hereby indemnify to the fullest extent David Seginer Photography from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these terms.

6. Severability

If any provision of these terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these terms unenforceable or invalid as a whole. Any such provisions shall be deleted without affecting the remaining provisions herein.

7. Variation of Terms

David Seginer Photography is permitted to revise these terms at any time as it sees fit, and by using this website you are expected to review these terms regularly.

8. Governing Law

These terms will be governed by and construed in accordance with the laws of the United States, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the United States for the resolution of any disputes.

9. Cancellation Policy

A non-refundable deposit is required to secure your booking date.
The deposit will be applied to the total cost of the photography services, with the remaining balance due on the day of service.
Cancellations, regardless of notice period, will result in forfeiture of the deposit.
Rescheduling is always an option, and we will make every effort to accommodate a new date. The deposit will be transferred to the new date.
In the event of unforeseen circumstances (e.g., severe weather, illness), David Seginer Photography reserves the right to reschedule the service date. The deposit will be applied to the rescheduled date.
If rescheduling is not possible and the service cannot be performed due to circumstances beyond our control, the deposit may be refunded at our discretion.

10. Retainer Policy

David Seginer Photography offers a long-term retainer option for clients who require ongoing photography services.
The retainer agreement involves a flat monthly fee, which secures a predetermined number of photography hours or sessions per month.
The minimum term for the retainer agreement is 3 months, after which it continues on a month-to-month basis.
The monthly retainer fee is due on the 1st of each month and must be paid via automatic recurring payment.
Unused hours or sessions from one month do not roll over to the next month.
Additional hours or sessions beyond the agreed-upon monthly allocation will be billed at a discounted rate.
Clients on the retainer plan receive priority scheduling.
Either party may terminate the retainer agreement with 30 days written notice.
Upon termination, any unused portion of the current month's retainer will not be refunded.
